Your Right to Stop Unsafe Work
Every worker in Canada has the legal right to refuse work that they believe is unsafe. This right is protected by occupational health and safety laws and is a critical part of maintaining a strong safety culture in the workplace.
When to Use Stop Work Authority
- When you identify a serious hazard with no immediate control.
- If you are asked to perform a task for which you are not trained or certified.
- If equipment appears damaged or unsafe to operate.
- If weather, structural conditions, or environmental factors present danger.
Steps to Refuse Unsafe Work
- Notify your supervisor or employer immediately.
- Remain in a safe place until the issue is resolved.
- Your employer must investigate the concern and take corrective action.
- If not resolved, you may contact your health and safety representative or regulator.
No Retaliation Allowed
- It is illegal for any employer to discipline or dismiss a worker for refusing unsafe work.
- Document your concern and follow up if needed with a union or safety body.
- Encourage others to speak up about hazards they have the same rights.
